Selling a car in Queensland involves more than just finding a buyer and exchanging keys for cash. In this blog post, we’ll explore why a roadworthy certificate is essential when selling a car in Queensland and we’ll point out the implications of not having one.

It is illegal to sell a registered vehicle in QLD without a valid roadworthy (aka safety certificate). This requirement applies to all vehicles including; cars, motorcycles, trailers, and caravans. A roadworthy safety certificate verifies that vehicle met the minimum safety standards outlined by the Department of Transport and Main Roads. What is a Roadworthy and Who Provides It? 

A roadworthy or safety certificate serves as proof that a vehicle meets the minimum safety standards required by the Department of Transport and Main Roads (TMR) to be legally driven on the road. The inspection is conducted by an AIS approved examiner – such as ASAP Roadworthys – who inspect various components of the vehicle including; brakes, tyres, steering, suspension, lights, body rust or damage, and more.

When selling a registered vehicle in Queensland, it is a legal requirement of the seller to provide the buyer with a current roadworthy safety certificate. This certificate assures the buyer that the vehicle they are purchasing is safe to drive and has passed a thorough safety inspection. Note: A roadworthy safety inspection is not a comprehensive mechanical inspection on the quality, or life expectancy of a vehicle, which would instead require a pre-purchase inspection.

Additionally, it is unethical and unsafe to sell a vehicle without ensuring its roadworthiness, as it puts the buyer at risk and could lead to accidents or mechanical failures on the road.

When Do You NOT Need a Roadworthy?

1. The vehicle is unregistered at the time of sale, or
2. It is a deregistered vehicle being sold for parts or scrap.
In these situations, the seller should clearly communicate the vehicle’s status to the buyer to avoid any legal or safety issues.

On the otherhand, if you are transferring a vehicle, a roadworthy is not required if:
1. You are a beneficiary of a deceased estate
2. You are transferring to a spouse
3. The original owner (referred to as a disposer) is in an exempt remote area (typically classified as at least 40 km from an urban centre with a minimum population of 14,000 or at least 100 kms from an urban centre that had a population of 130,000 or more).
